Battery is a serious criminal charge that can lead to significant penalties and lasting impacts on your personal and professional life. 

  • Misdemeanor Battery is a Class A Misdemeanor with a maximum punishment of 364 days in County Jail and a fine of up to $2500 or a combination of the two.

Aggravated Battery is an elevated charge that can result from numerous factors including, but not limited to, the severity of the injuries alleged, the age of the victim, the occupation of the victim, the alleged reason for the battery, the use of weapons during the incident, and attempts to conceal identity during alleged incidents.

  • At its simplest charge, Aggravated Battery is a Class 3 Felony with a sentencing range of 2 – 5 years (5 – 10 years if eligible for extended term) in the Illinois Department of Corrections and a fine of up to $25,000 or a combination of the two.
  • At its most severe, Aggravated Battery is a Class X Felony with a sentencing range of 25 years to natural life in the Illinois Department of Corrections.
